PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THIS SITE.

CardCove.io (the "Site") is owned and operated by Ethereal Springs LLC, a Texas entity ("CardCove," "we," "us," or "our"), with its principal business address at 817 S MacArthur Blvd, Ste 115 PMB 2037, Coppell, TX 75019. By accessing, browsing, purchasing from, or otherwise using the Site — including by automated means — you agree to be bound by these Terms of Service (the "Terms" or this "Agreement"). If you do not agree, do not use the Site, purchase gift cards, or create an account.

YOU MUST BE 18 YEARS OF AGE OR OLDER AND A U.S. RESIDENT TO USE THIS SITE.


Part A — The Agreement

A1. Acceptance. These Terms are the entire agreement between you and CardCove regarding the Site and supersede all prior agreements and understandings, except for any separately executed Buyer Purchase Agreement between you and CardCove, which controls for the order it covers in the event of a conflict. Completing a purchase, or accessing the Site by any automated means, constitutes your acceptance of these Terms.

A2. Business Entities. If you use the Site on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms, in which case "you" and "your" refer to that entity. If you lack such authority, you may not use the Site on the entity's behalf.

A3. Amendments. We may amend these Terms at any time without specific notice to you. The current version will always be posted on the Site, and your continued use of the Site after any change constitutes acceptance of the revised Terms. You should review these Terms before each use of the Site.

A4. Definition of "Gift Card(s)." As used on this Site, "gift card(s)" or "card(s)" means digital gift card numbers (with or without PINs), whether originally purchased for personal use or as gifts, or issued as merchandise credit for any reason, or any combination of these, which at the time of sale are accepted by the issuing retailer in the form in which CardCove sells them. CardCove is an independent reseller. CardCove is not the issuer of any gift card sold on the Site and is not affiliated with, endorsed by, or sponsored by any merchant whose trademarks or gift cards appear on the Site.


Part B — Accounts, Identity, and Verification

B1. Account Accuracy; Fraud. By becoming a customer, you confirm that all information you provide to us is true, accurate, and complete. Your account may be suspended or canceled without notice if we determine, in our sole discretion, that false or misleading information has been provided, these Terms have been violated, identity verification cannot be completed, payment risk exists, or other abuse has occurred. If an account is revoked, CardCove reserves the right to refuse readmission. CardCove may withhold delivery of any order or suspend any account pending completion of identity verification or fraud review.

B2. Identity and Location Verification. Completion of identity verification is a condition of purchasing on the Site. You authorize CardCove to verify your identity through Veriff, our third-party identity verification provider, which may involve capturing images or video of your government-issued ID and a live selfie. You further authorize CardCove to (a) request that your mobile carrier use your mobile subscriber details to verify your identity, (b) perform background checks or access personal information from credit bureaus for fraud-prevention purposes, and (c) collect device, network, and geolocation signals — including detection of proxy, VPN, or remote-access usage — to assess transaction risk. You authorize your mobile carrier and its authorized data sources to provide your account and subscriber information to us, including (if available) your name, address, email, and device data, for these purposes. CardCove may withhold delivery, cancel orders, or suspend accounts where verification is incomplete, fails, or indicates elevated risk.

B3. Account Security; Nontransferable. Your right to use the Site is personal to you and is not transferable. Any password or access right given to you may only be used by you. You are solely responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

B4. Address and Information Verification. CardCove reserves the right to contact you by email to verify the accuracy of your account information (including your correct name and address) as needed to service your account.

B5. Lapsed Accounts. If you do not access your account for 90 days or more, CardCove may, in its sole discretion, terminate the account. We will endeavor to notify you at your email address on file at least ten days before deactivation; if you do not respond within 10 days of the notice being sent, the account will be terminated. You agree that failure to access your account for 90 days or more conclusively indicates abandonment. CardCove has no obligation to maintain accounts that appear abandoned, so keep your account and contact information current and in use.


Part C — Purchases, Payment, and Delivery

C1. Payment Representations. When purchasing from us, you represent and warrant that (i) all payment information you supply is true, correct, and complete, (ii) you are the authorized holder of the payment method used, (iii) charges you incur will be honored by your bank, card issuer, or payment provider, and (iv) you will pay all charges at the posted prices, including any fees and applicable taxes.

C2. Payment Processing and Storage. By providing payment information, you authorize CardCove to submit it to a secure third-party payment processor and/or payment gateway. Our processors adhere to security standards managed by the PCI Security Standards Council. If you elect to save a payment method for future use, it is stored with our secure processor or gateway — CardCove does not itself store full payment card numbers. Your use of any payment method is also subject to the processor's own terms.

C3. Pricing Errors; Right to Refuse. CardCove reserves the right to refuse any order. If an order or coupon reflects a pricing mistake, CardCove may notify you to pay the difference or cancel the order. CardCove may cancel any order at any time; for undelivered items, a refund of amounts actually paid is your sole remedy for such cancellation.

C4. Electronic Delivery; Risk of Loss. All gift cards purchased on CardCove.io are delivered electronically to your CardCove account. Most orders are processed and delivered within minutes; however, orders subject to identity verification or fraud review may take up to 24 hours or longer. Delivery to your account constitutes complete performance by CardCove, and risk of loss passes to you at that moment. Once delivered, you can access and manage your gift cards directly through your account.

C5. Fulfillment Errors. CardCove may cancel an order in whole or in part for items that are out of stock or omitted in fulfillment. If notified of an omitted item, CardCove may, in its sole discretion, re-deliver it at no cost; if it does not, it will refund that portion of the order within 24–72 hours. If CardCove delivers extra cards or a card of greater value than purchased, you agree to notify us within 7 business days, and we will provide instructions to return or surrender the card. If the card is not returned or surrendered, CardCove reserves the right to charge you for the difference.


Part D — Refunds and the 101-Day Buyer Guarantee

D1. All Sales Final — No Refunds. Due to the nature of digital gift cards, ALL SALES ON CARDCOVE.IO ARE FINAL. CardCove maintains a strict NO REFUND and NO RETURN policy. No product may be returned, exchanged for a like item, or refunded for cash, and orders cannot be canceled once placed. The sole and exclusive exception to this policy is a valid claim under the 101-Day Buyer Guarantee described in Section D2.

D2. 101-Day Buyer Guarantee. Every card sold on CardCove is covered by our 101-Day Buyer Guarantee. A card qualifies for a remedy under this guarantee only if, before you were able to use it, the card (a) was invalid, (b) was cancelled by the issuing merchant, or (c) carried no balance or a balance lower than the stated value at the time of sale (each, a "Bad Card"). To make a claim:

  • You must contact us at support@cardcove.io within 101 days of the purchase date. Claims made after 101 days are not eligible, even if the issue arose within the guarantee period. We recommend keeping a timestamped copy of your claim submission.
  • We will respond within 24 hours to request any information needed and will open an investigation, which may take up to 14 business days to complete.
  • If our investigation determines that the discrepancy was not due to your use, disclosure, or handling of the card, we will, at our option, replace the card or, if a replacement is unavailable, refund the purchase price of the affected card.

Card replacement or refund under this Section is your sole and exclusive remedy for any defective, invalid, or discrepant card. This guarantee is void for any order subject to a chargeback, payment reversal, or fraud review, and does not cover balances used, shared, or depleted after delivery to your account. After 101 days, CardCove bears no responsibility for balance discrepancies or merchant cancellations.

D3. Merchant Redemption Risk. If you use a valid gift card and the issuing merchant subsequently voids, freezes, or refuses it for any reason — including a suspected or actual breach of the merchant's own terms and conditions, suspected fraud, changes to its gift card acceptance policy, or the merchant's bankruptcy — CardCove is not liable for any resulting loss and will not provide a refund or replacement. You are responsible for reviewing and complying with each merchant's redemption terms before purchasing and using a card. If you return or exchange merchandise purchased with a gift card, the merchant's own policies apply, and you may receive only store credit; contact the merchant directly with any questions.

D4. Scam Awareness and Prohibited Uses. Legitimate organizations do not request payment in gift cards. Fraudsters may impersonate government agencies, utilities, law enforcement, or charities and demand gift cards for supposed debts, taxes, fines, or fees — if you receive such a demand, verify through official channels before paying anyone. Cards purchased on CardCove are solely for your own personal use or as genuine gifts, at your own discretion and free of any third party's pressure, coercion, or direction; they may never be used to pay a purported debt, tax, fine, fee, or ransom. If you buy cards at a third party's direction or as payment in a scam, you do so at your own risk and in violation of these Terms. Delivered and redeemed cards cannot be reversed, CardCove will not refund or replace cards lost to scams or misuse, and you release and hold CardCove harmless from any resulting claims or damages.


Part E — Non-Payment, Chargebacks, and Collections

E1. Valid Payment Required. By purchasing from CardCove.io, you agree to provide valid payment for every order placed.

E2. Consequences of Non-Payment. In the event of non-payment — including failure to complete payment, a returned or reversed ACH transaction, or a chargeback that results in CardCove not receiving payment — CardCove reserves the right to (i) invalidate, deactivate, or reclaim any gift cards delivered in connection with the unpaid order, to the extent permitted; (ii) suspend or terminate your account; (iii) offset the unpaid amount against any credit, balance, or pending order on your account; and (iv) refer your account to collections. If your account is referred to a collections agency, you agree to be responsible for all associated fees, collection costs, and legal costs incurred. CardCove reserves the right to pursue further legal action for continued non-payment.

E3. Chargebacks on Delivered Goods. You acknowledge that electronic delivery to your account constitutes complete performance by CardCove. To the fullest extent permitted by applicable law and card network rules, you agree not to initiate a chargeback or payment dispute on any delivered order, and to resolve any issue exclusively through the 101-Day Buyer Guarantee process in Part D. A chargeback filed on a valid, delivered order constitutes a material breach of this Agreement.

E4. Interest on Unpaid Balances. Interest shall accrue on any unpaid invoice, unpaid balance, or amount owed to CardCove — including amounts arising from overpayments, unwarranted refunds, or unwarranted card replacements — at the rate of 1.5% per month (18% per annum) or the maximum rate permitted by applicable law, whichever is less, beginning ten (10) days after the amount becomes due or after demand for repayment is delivered to you.


Part F — Use of the Site

F1. Intellectual Property; Limited License. The content, organization, graphics, design, compilation, and all other matters related to the Site are protected under applicable copyrights, trademarks, and other proprietary rights. Viewing, printing, or downloading any content from the Site grants you only a limited, nonexclusive license for your own personal use — not for republication, distribution, assignment, sublicense, sale, preparation of derivative works, resale, or redistribution. You acquire no ownership rights in any content viewed through the Site, and the posting of materials on the Site does not waive any right in those materials.

F2. Prohibited Uses and Data Scraping. You agree not to access or use CardCove.io or its related services for any purpose other than your personal or permitted purchasing use. Without limiting the foregoing, you agree not to:

  1. Use any automated system, bot, scraper, spider, or similar technology to access, extract, harvest, or monitor any data, pricing, or content from CardCove.io or its affiliated properties;
  2. Use any data obtained from CardCove.io — directly or indirectly, including through third-party aggregators — for commercial, competitive, or derivative purposes, including dynamic pricing, resale, or publication on any other platform;
  3. Circumvent or attempt to bypass any security, rate-limiting, or access-control measure on the Site;
  4. Access or use CardCove.io or its APIs in violation of these Terms, or in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party's use;
  5. Purchase gift cards using stolen, unauthorized, or fraudulently obtained payment methods, or use the Site in connection with money laundering, structuring, or any unlawful activity;
  6. Misrepresent your identity, use another person's identity or payment credentials, or create multiple accounts to evade limits, verification, or suspension.

CardCove reserves the right to take all appropriate action in response to such conduct, including termination of access, suspension of accounts, cancellation of pending orders, and pursuit of damages or injunctive relief.

F3. Site Content Changes. We reserve the right, in our sole discretion, to edit or delete any documents, information, or other content appearing on the Site, including this Agreement, without further notice.

F4. Submissions. All suggestions, ideas, notes, concepts, and other information you send to us (collectively, "Submissions") are deemed and shall remain our sole property, free of any obligation of confidence. We own all rights of every kind in the Submissions and may use them for any purpose without compensation to you.

F5. Third-Party Merchants and Links. We may allow access to or advertise third-party merchant sites ("Merchants"). We do not operate or control Merchants' products or services; Merchants are responsible for all order processing, fulfillment, billing, and customer service on their own sites, and their rules, policies, and privacy practices apply to you while there. We are not a party to transactions between you and Merchants, and we are not responsible for information you provide to them. We and the Merchants are independent contractors, and neither has authority to bind the other. The Site may also contain links to other websites that we do not investigate, monitor, or verify; inclusion of a link does not imply our endorsement, and you access third-party sites at your own risk. USE OF MERCHANTS AND LINKED SITES IS AT YOUR SOLE RISK AND WITHOUT WARRANTIES OF ANY KIND BY US, AND UNDER NO CIRCUMSTANCES ARE WE LIABLE FOR ANY DAMAGES ARISING FROM TRANSACTIONS BETWEEN YOU AND MERCHANTS OR FROM ANY INFORMATION APPEARING ON THEIR SITES.


Part G — Legal Terms

G1. Disclaimer of Warranties. THE INFORMATION, PRODUCTS, AND SERVICES FROM OR THROUGH THE SITE ARE PROVIDED "AS-IS" AND "AS AVAILABLE," AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED (INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE). THE INFORMATION AND SERVICES MAY CONTAIN BUGS, ERRORS, PROBLEMS, OR OTHER LIMITATIONS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US THROUGH THE SITE CREATES ANY WARRANTY, REPRESENTATION, OR GUARANTEE NOT EXPRESSLY STATED IN THIS AGREEMENT.

G2. Limitation of Liability. WE AND OUR AFFILIATED PARTIES (DEFINED BELOW) HAVE NO LIABILITY WHATSOEVER FOR YOUR USE OF ANY INFORMATION OR SERVICE, AND WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, LITIGATION, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING ANY DAMAGES CAUSED BY VIRUSES CONTAINED WITHIN ANY ELECTRONIC FILE. OUR MAXIMUM AGGREGATE LIABILITY TO YOU UNDER ALL CIRCUMSTANCES WILL BE EQUAL TO THE PURCHASE PRICE YOU ACTUALLY PAID TO CARDCOVE FOR THE SPECIFIC GOODS, SERVICES, OR INFORMATION GIVING RISE TO THE CLAIM. THE NEGATION AND LIMITATION OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN US; THIS SITE AND ITS PRODUCTS WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS. CardCove is likewise not liable for actions taken by merchants or third-party companies that result in the closure of your accounts, confiscation of funds, or other adverse action toward you; all transactions facilitated through our platform are subject to the policies and actions of the respective merchants and third parties, over which we have no control. Our liability is limited to transactions directly conducted through our platform, and disputes arising from your engagement with third-party companies, websites, or programs cannot be taken out on CardCove.

G3. Indemnification. You agree to indemnify, defend, and hold us and our officers, directors, shareholders, members, managers, partners, attorneys, staff, contractors, and affiliates (collectively, "Affiliated Parties") harmless from any liability, loss, claim, and expense, including reasonable attorney's fees, related to your violation of this Agreement, your use of the Site, your use or resale of any gift card purchased through the Site, or any chargeback or payment dispute you initiate in bad faith.

G4. Privacy Policy; Use of Information. Our Privacy Policy is part of this Agreement and may change from time to time. We reserve the right, and you authorize us, to use and assign all information regarding your use of the Site and all information you provide, in any manner consistent with our Privacy Policy.

G5. Governing Law; Venue. This Site is created and controlled by Ethereal Springs LLC d/b/a CardCove in the State of Texas, USA, and the laws of the State of Texas govern this Agreement without giving effect to conflicts-of-law principles. Subject to Section G6, YOU AGREE THAT ALL ACTIONS OR PROCEEDINGS ARISING DIRECTLY OR INDIRECTLY OUT OF THIS AGREEMENT OR YOUR USE OF THE SITE SHALL BE LITIGATED EXCLUSIVELY IN THE STATE COURTS LOCATED IN DALLAS COUNTY, TEXAS OR THE UNITED STATES DISTRICT COURT FOR THE NORTHERN DISTRICT OF TEXAS. YOU EXPRESSLY SUBMIT AND CONSENT IN ADVANCE TO SUCH JURISDICTION AND WAIVE ANY CLAIM THAT SUCH FORUM IS INCONVENIENT OR IMPROPER.

G6. Arbitration; Class Action Waiver. Except for (a) actions by CardCove to collect amounts owed, (b) claims for injunctive relief relating to intellectual property, scraping, or fraud, and (c) claims properly brought in small claims court, any dispute, claim, or controversy arising out of or relating to this Agreement or your use of the Site shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in Dallas County, Texas or remotely by videoconference. YOU AND CARDCOVE EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. All claims must be brought in the parties' individual capacity. Any claim must be filed within one (1) year after the cause of action arises, or it is permanently barred.

G7. Compliance With Law; Sanctions. You represent that you are not located in, and are not a resident or national of, any country subject to U.S. embargo or sanctions, and that you are not on any U.S. government restricted-party list. You agree to use the Site and any gift cards purchased through it in compliance with all applicable laws, including anti-money laundering laws.

G8. Severability; No Waiver. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions continue in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
